By accessing and using the DebateGenius platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service.

DebateGenius is an AI-powered platform for creating, viewing, and sharing AI-generated debates on various topics. The Service includes:

• AI-generated debate content featuring slide-based presentations with karaoke-style text synced to professional AI voices
• Video and audio synthesis for debate presentations
• User account management and debate history
• Community features including public debate proposals and funding

4. AI-Generated Content Disclaimer

DebateGenius uses artificial intelligence models from third-party providers (OpenAI, Anthropic, Google) to generate debate content. By using our Service, you acknowledge and agree that:

• AI-generated debates present arguments and counterarguments that may contain inaccuracies, false statements, or misleading information
• Debate content is designed for entertainment and educational purposes to explore different perspectives on topics
• You should not rely on debate content as factual information, professional advice, or authoritative guidance on any subject matter
• All AI-generated content is provided by third-party AI model providers, not by DebateGenius
• DebateGenius is not responsible for the accuracy, completeness, reliability, or appropriateness of AI-generated debate arguments
• You assume all risk associated with relying on, sharing, or acting upon debate content
• DebateGenius does not endorse any positions, arguments, or viewpoints presented in AI-generated debates

Important: Do not enter personal information (such as names, addresses, phone numbers, or other identifying details) into the debate topic generator. AI-generated content may be reviewed for service improvement.

By using the debate generator, you confirm that you have the right to submit the content you provide, and you give us permission to share that content with our AI provider, OpenAI, including under OpenAI's data-sharing program for model improvement. You also agree not to include personal, sensitive, or confidential information in your prompts.

5. User Accounts

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

6. Acceptable Use Policy

You agree not to use the Service to:

• Generate content that is harmful, offensive, or discriminatory
• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use the Service for commercial purposes without authorization
• Generate misleading or false information intended to deceive
• Submit debate topics containing personal information about yourself or others

8. Payments and Refunds

Payment terms vary by service tier:

• Unlock Debates: $1 deducted from wallet balance per debate for permanent streaming access
• Public Proposals: Minimum $2 from wallet balance toward a $30 funding goal. If the goal is not met, contributions are automatically refunded to your wallet
• Private Debates: $50 deducted from wallet balance per debate for priority creation with streaming and download access

You can add funds to your wallet balance in any amount you choose. All wallet deposits are processed securely through Stripe. When you add funds, you authorize DebateGenius to charge the payment method associated with your account. Refund policies are as described above and on the pricing page.

9. Termination and Suspension

We may suspend or terminate access to the Service for violations of these Terms or for security reasons. Upon termination, your right to use the Service ceases immediately and we may delete your account and associated data in accordance with our data retention policies. Downloaded content from Private Debates remains yours after account termination.

10. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect, use, and safeguard your information.

11. Availability and Modifications

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. Debate generation typically takes 1-2+ hours and may vary based on system load. We may modify, suspend, or discontinue the Service at any time with reasonable notice.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

13. Limitation of Liability

To the maximum extent permitted by law, DebateGenius and Dr Olawale Titiloye shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill arising from:

• Your use of or inability to use the Service
• Any AI-generated content, including inaccuracies or harmful statements
• Reliance on debate content for any decision-making
• Unauthorized access to your account or data
• Any other matter relating to the Service

Our total liability to you for all claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or £100, whichever is greater.

14. Indemnification

You agree to indemnify, defend, and hold harmless DebateGenius, Dr Olawale Titiloye, and our service providers from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your use or sharing of AI-generated content

15. Changes to These Terms

We may revise these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the new Terms. We will notify you of material changes via email or in-product notifications.

16. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer in the European Union, you may also have the right to raise concerns with your local consumer protection authority.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
